Arborist Equipment Online Store Sales Terms and Conditions

The owner of the Online Store arbogear.com, specializing in tree climbing gear and arborist supplies, is Arborist OÜ (registry code 11315830), located at Savi tn 3/2, Pärnu city, Pärnu County, 80040, Republic of Estonia.

Validity of the sales contract, goods and price information

Terms of sale are valid for purchasing tree climbing equipment and other goods from the Online Store.

Prices for tree climbing gear and other products sold in the Online Store are listed with the products. A fee is added to the price for the delivery of the goods if the courier or parcel machine service is chosen as the mode of transport. There is no transport fee added when picking up the tree climbing gear yourself. All prices of tree climbing equipment and other goods sold in the Online Store are in euros.

The cost of all tree climbing gear and other products can be seen with and without VAT using the VAT on and off function in the upper right corner of the page.

The cost of delivery depends on the buyer’s location and the delivery method. The delivery fee is shown to the buyer during the order process.

Information about the tree climbing equipment, arborist supplies, and other goods is provided in the Online Store right next to the item.

To buy tree climbing gear or any other products from the Online Store, the Buyer does not need to register in advance.

Making an order

To order goods, you must add the desired products to the basket.

In the shopping cart, the Buyer can delete products and change their quantities.

The products included in the shopping cart do not oblige the Buyer to pay yet, as the purchase order has not been placed at that time.

The products added to the shopping cart are not reserved for the Buyer, i.e., these products are for sale to other buyers at the same time.

To complete the order, you must fill in the required fields and select the appropriate delivery method. The amount of the fee will then be displayed on the screen, which can be paid securely through the following payment methods:

Payment is made outside the Online Store in a secure environment – when paying with a bank link in the secure environment of the respective bank and when paying with a credit card in a secure environment on PayPal or Stripe. The seller does not have access to the customer’s bank and credit card details. The Agreement enters into force when the sum payable has been credited to the Online Store’s bank account.

The owner of the Online Store is the chief processor of personal data and transmits the personal data necessary for making payments to the authorized processor.

If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be informed as soon as possible, and the money (including delivery costs) will be returned promptly, but not later than within 14 days after sending the notice.

Shipping

Purchases made in the Online Store are processed on working days (Mon-Fri 10.00-15.00). If the time of making the purchase is after 13:00, the purchase will be sent to the Buyer on the next working day.

Delivery times for goods that are not in stock will be specified by e-mail before or after the order.

The cost of sending the goods is borne by the buyer, and the corresponding price information is displayed next to the delivery method.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 45 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 45-day right of withdrawal, you must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics, and functioning of the goods in the same way you would be allowed to test the goods in a physical store.

If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics, and functioning of the goods, or if there are any signs of use or wear and tear, the Online Store has the right to lower the amount returned in accordance with the decrease in the value of the goods.

To return the goods, you must submit a declaration of withdrawal to the e-mail address info@arbogear.com within 45 days of receiving the goods.

The purchaser shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective product).

The purchaser must return the goods within 45 days of the submission of the declaration of withdrawal or submit evidence that they handed over the goods to the carrier within the aforementioned period.

Upon receiving the returned goods, the online store shall return to the purchaser, promptly but no later than after 45 days, all of the payments received from the purchaser based on the contract.

The Online Store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the products, depending on whichever occurs first.

If the buyer has clearly chosen a different delivery method than the cheapest usual delivery method offered by the Online Store, the store is not required to compensate the cost exceeding the usual delivery cost.

The Online Store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.

The right to file a complaint

The Online Store is responsible for the non-compliance of goods sold to a purchaser with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery, and which occur within two years of delivering the goods to the purchaser. Within the first six months of delivery, it is assumed that the defect was present at the time of delivery. It is the Online Store´s responsibility to prove otherwise.

The buyer has the right to contact the Online Store within two months if a defect occurs, by sending an e-mail to info@arbogear.com.

The Online Store is not liable for any defects arising after delivering the goods to the purchaser.

If goods bought from the online store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store shall return to the purchaser all the payments involved in the contract of sale.

The Online Store will respond to the consumer´s complaint in written form or in a format which can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The Online Store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The Online Store sends personal information to the transport service companies to deliver the goods.

The Online Store sends newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed an interest for it by entering the email address on the web site and has indicated his/her wish to receive direct mail notifications.

The purchaser can at any time cancel the offers and newsletters sent to the email by sending us an email or by following the instructions in the email containing the offers.

Settlement of disputes

If the buyer has any complaints about the Online Store, these should be sent to the email address info@arbogear.com

The purchaser may also turn to the dispute resolution bodies of the European Union.
